1. Introduction

1.1. These Terms & Conditions govern your use of the Fox & Bloom Floral Artistry website and the purchase of any products or services from us.

1.2. By accessing our website or placing an order, you confirm that you have read, understood and agree to be bound by these Terms & Conditions.

1.3. Throughout these Terms & Conditions, "Fox & Bloom Floral Artistry", "we", "our" and "us" refer to Fox & Bloom Floral Artistry. "You" and "your" refer to the customer.

2. Our Products

2.1. We offer fresh flowers, bouquets, floral arrangements, gifts, wedding floristry and event floristry.

2.2. Flowers are natural products. Colours, sizes, shapes and varieties may vary from photographs shown on our website.

2.3. Images on our website are provided for illustration purposes only.

3. Seasonal Availability & Substitutions

3.1. Flower varieties are subject to seasonal and supplier availability.

3.2. Where a particular flower or foliage is unavailable, we reserve the right to substitute it with a suitable alternative of equal or greater value while maintaining the overall style, colour palette and design.

3.3. We will always aim to create arrangements that closely reflect those advertised or agreed.

4. Pricing & Payment

4.1. All prices displayed on our website are in Pounds Sterling (£).

4.2. Prices include VAT where applicable.

4.3. Payment must be received in full before an order is processed unless otherwise agreed in writing.

4.4. We reserve the right to amend prices at any time. Any changes will not affect orders already confirmed.

5. Orders

5.1. All orders are subject to acceptance and availability.

5.2. Once your order has been confirmed, you will receive an order confirmation by email.

5.3. We reserve the right to refuse or cancel an order where:

Products become unavailable.
Payment cannot be authorised.
Pricing errors occur.
Fraud or suspicious activity is suspected.

If payment has already been taken for a cancelled order, a full refund will be issued.

6. Delivery & Collection

6.1. Delivery dates requested by customers are treated as requested dates rather than guaranteed delivery times.

6.2. We will make every reasonable effort to deliver your order on the requested date.

6.3. Delivery delays caused by severe weather, traffic, accidents, road closures or circumstances beyond our control shall not constitute a breach of contract.

6.4. If the recipient is unavailable, we may:

Leave the flowers in a safe place where appropriate.
Leave the flowers with a neighbour.
Attempt redelivery (additional charges may apply).

6.5. Customers are responsible for ensuring delivery addresses and contact details are accurate at the time of ordering.

7. Fresh Flower Care

7.1. Fresh flowers are perishable products.

7.2. Customers should follow the care instructions supplied to maximise vase life.

7.3. We cannot accept responsibility for deterioration caused by failure to follow care instructions after delivery.

8. Wedding & Event Floristry

8.1. Wedding and event floral designs are bespoke products created specifically for your requirements.

8.2. A non-refundable booking fee is required to secure your event date.

8.3. Final balances must be paid by the date specified in your quotation or invoice.

8.4. Any changes requested after final confirmation may not be possible and may incur additional costs.

8.5. We reserve the right to substitute flowers where seasonal availability or supplier issues require this, whilst maintaining the agreed style and value wherever possible.

9. Cancellations & Refunds

9.1. Our Cancellation Policy and Return & Refund Policy form part of these Terms & Conditions.

9.2. Fresh flowers and bespoke wedding floristry are exempt from the standard 14-day cancellation period under the Consumer Contracts Regulations due to their perishable and personalised nature.

10. Customer Responsibilities

10.1. You are responsible for providing accurate information when placing an order.

10.2. We are not responsible for delays or losses resulting from incorrect addresses, incorrect recipient details or incomplete information supplied by the customer.

11. Intellectual Property

11.1. All content on this website, including photographs, logos, text, graphics and designs, is owned by or licensed to Fox & Bloom Floral Artistry.

11.2. No content may be copied, reproduced or distributed without our prior written permission.

12. Website Availability

12.1. We aim to keep our website available at all times but cannot guarantee uninterrupted access.

12.2. We reserve the right to suspend, modify or withdraw any part of our website without notice.

13. Limitation of Liability

13.1. Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

13.2. Subject to clause 13.1, our total liability in relation to any order shall not exceed the amount paid for that order.

13.3. We shall not be liable for indirect or consequential loss arising from the use of our website or products.

14. Force Majeure

14.1. We shall not be liable for failure or delay in performing our obligations where caused by events beyond our reasonable control, including but not limited to severe weather, flooding, road closures, pandemics, supplier shortages, strikes or other unforeseen circumstances.

15. Privacy

15.1. Your personal information will be processed in accordance with our Privacy Policy.

15.2. By placing an order, you consent to the processing of your information as described in that policy.

16. Governing Law

16.1. These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

16.2. Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
